Terms and Conditions

This driver parking app (the “Shofer”) is a service that allows you to pay for parking in various locations using your mobile device. The App is operated by The i-Capital Africa Institute (the “Company”), a company with its principal place of business at Addis Ababa, Ethiopia. By downloading, installing, or using the App, you agree to be bound by these terms and conditions (the “Terms”), as well as our privacy policy (the “Privacy Policy”), which is incorporated by reference. If you do not agree with these Terms or the Privacy Policy, please do not use the App.

  • License and Access to the App the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use, subject to these Terms and any applicable laws and regulations. You may not copy, modify, distribute, sell, lease, rent, sublicense, or create derivative works from the App or any part of it. You may not reverse engineer, decompile, or disassemble the App or attempt to discover its source code or underlying algorithms. You may not use the App for any illegal, fraudulent, or unauthorized purpose, or in any way that violates the rights of any third party.
  • Account Registration and Security To use the App, you must register for an account (the “Account”) and provide certain information about yourself, such as your name, email address, phone number, vehicle license plate number, and payment method. You agree to provide accurate, current, and complete information when registering for an Account and to update it as necessary. You are responsible for maintaining the confidentiality and security of your Account and password, and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized access or use of your Account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this section.
  • Payment and Fees The App allows you to pay for parking in participating locations (the “Parking Locations”) by entering the zone number displayed on the parking meter or signage. You can choose to pay for a single parking session (the “Parking Session”) or to activate a recurring payment option (the “AutoPay”) that automatically charges your payment method for each Parking Session until you deactivate it. You are responsible for selecting the correct zone number and duration of your Parking Session and for ensuring that your payment method has sufficient funds to cover the fees. You can view your transaction history and receipts in the App.

The fees for using the App are based on the rates set by the Parking Location operators (the “Parking Operators”) and may vary depending on the location, time, and duration of your Parking Session. The fees may also include a convenience fee charged by the Company for providing the App service. The fees are subject to change at any time without notice. You agree to pay all fees incurred by using the App, including any taxes and surcharges that may apply. The fees will be charged to your payment method at the end of each Parking Session or at regular intervals if you use AutoPay. You authorize us to charge your payment method for all fees due and to share your payment information with our payment processor and the Parking Operators.

  • Refunds and Disputes You can request a refund for any overpayment or erroneous charge within 30 days of the transaction date by contacting our customer support center at [phone number] or [email address]. We will process your refund request within a reasonable time and notify you of the outcome. Refunds will be issued to your original payment method or as a credit to your Account, at our sole discretion.

If you have any dispute or complaint regarding the parking services provided by the Parking Operators, such as parking enforcement, citations, towing, or damage to your vehicle, you must contact the Parking Operator directly and follow their dispute resolution process. We are not responsible or liable for any acts or omissions of the Parking Operators or their agents.

  • Disclaimer of Warranties The App is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, accurate, reliable, or compatible with your device or network. We do not warrant that the App will meet your requirements or expectations, or that any defects will be corrected. Your use of the App is at your own risk and discretion.
  • Limitation of Liability To the fullest extent permitted by law, we and our affiliates, directors, officers, employees, agents, and licensors will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the App, even if we have been advised of the possibility of such damages. In no event will our total liability to you for all claims arising from or relating to the App exceed the amount of fees paid by you to us in the 12 months preceding the claim.
  • Indemnification You agree to indemnify, defend, and hold harmless us and our affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to your use of or access to the App, your violation of these Terms or any applicable laws or regulations, or your infringement of any rights of any third party.
  • Termination and Suspension We reserve the right to terminate or suspend your Account and access to the App at any time, for any reason or no reason, with or without notice. Upon termination or suspension of your Account, you will lose all access to the App and any information stored in your Account. You may also terminate your Account at any time by contacting our customer support center at +251 11 812 06 00 or info@icapitalafrica.org. Termination of your Account will not affect any rights or obligations that arose prior to the termination.
  • Changes to these Terms We may revise and update these Terms from time to time in our sole discretion. We will notify you of any changes by posting the new Terms on the App or by sending you an email. The changes will be effective immediately for new users and after 30 days for existing users. Your continued use of the App after the effective date of the changes will constitute your acceptance of the new Terms. If you do not agree with the new Terms, you must stop using the App and delete it from your device.
  • Miscellaneous These Terms constitute the entire agreement between you and us regarding the App and supersede any prior or contemporaneous agreements or communications. These Terms do not create any partnership, joint venture, employment, or agency relationship between you and us. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. We may assign our rights and obligations under these Terms to any third party without your consent. You may not assign your rights and obligations under these Terms without our prior written consent.
